He had traveled abroad and still had a pending immigration petition to remove the conditions on his residency.<\/p><p class=\"wp-block-paragraph\">When he appeared before Customs and Border Protection, his return took a different turn.<\/p><p class=\"wp-block-paragraph\">Authorities determined that one of his prior convictions could constitute a crime involving moral turpitude and therefore treated him as a foreign national who had to seek admission to the country again. The next day, he was placed in the custody of Immigration and Customs Enforcement.<\/p><p class=\"wp-block-paragraph\">Olivarez George, a citizen of the Dominican Republic, had received conditional permanent residence in September 2019. In August 2021, he filed Form I-751 to remove the conditions on that status. <a data-efl-existing-link=\"1\" href=\"https:\/\/elfarolatino.com\/en\/tifon-dolphin-golpea-china-y-obliga-a-evacuar-a-mas-de-un-millon-de-personas\/\">More than<\/a> five years later, the petition was still pending.<\/p><p class=\"wp-block-paragraph\">His criminal history also became central to the case. In January 2024, he was convicted in Georgia on three counts involving simple assault, criminal trespass and obstruction of an emergency telephone call. He received eight months of incarceration on one count and consecutive periods of probation on the others.<\/p><p class=\"wp-block-paragraph\">ICE argued that at least one of those convictions could make him inadmissible.<\/p><p class=\"wp-block-paragraph\">But the discussion began to change in immigration court.<\/p><p class=\"wp-block-paragraph\">During two hearings held in July and August 2025, the immigration judge did not decide his bond request while considering whether the convictions actually qualified as crimes involving moral turpitude.<\/p><p class=\"wp-block-paragraph\">On September 29 of that year, the Dominican man received a favorable decision. The immigration judge concluded that none of the offenses for which he had been convicted fit that category and ordered the removal proceedings terminated.<\/p><p class=\"wp-block-paragraph\">However, Olivarez George did not regain his freedom.<\/p><p class=\"wp-block-paragraph\">The Department of Homeland Security appealed the decision to the Board of Immigration Appeals, reopening the case. While the appeal moved slowly, the Dominican man remained detained primarily at the Krome North Service Processing Center in Miami-Dade.<\/p><p class=\"wp-block-paragraph\">The wait also affected his health. According to the federal record, he was hospitalized for influenza during his detention and suffered an adverse reaction to antibiotics. He later returned to immigration custody while symptoms continued.<\/p><p class=\"wp-block-paragraph\">In February 2026, he filed a new habeas corpus petition in the U.S. District Court for the Southern District of Florida. His argument was direct: his detention had continued indefinitely without any authority making a genuine determination about whether he should remain jailed or could be released on bond.<\/p><p class=\"wp-block-paragraph\">Federal Judge Kathleen M. Williams ultimately agreed.<\/p><p class=\"wp-block-paragraph\">In an order issued August 12, Williams noted that Olivarez George had been detained for more than 13 months, a period longer than the eight months he had spent incarcerated for his criminal case in Georgia.<\/p><p class=\"wp-block-paragraph\">The judge also noted that the process had been extended by the government\u2019s appeal and that the Dominican man had participated diligently in his immigration proceedings.<\/p><p class=\"wp-block-paragraph\">Her conclusion was clear: keeping him detained for that long without a full custody review and without a bond decision violated his due-process rights.<\/p><p class=\"wp-block-paragraph\">Williams granted the habeas corpus petition and ordered the government to hold an individualized bond hearing within seven days. If the hearing did not take place, Olivarez George was to be released.<\/p><p class=\"wp-block-paragraph\">The decision did not finally resolve his immigration status or determine whether he could remain in the United States.<\/p><p class=\"wp-block-paragraph\">But after more than a year in custody, it established something that had previously been denied to him: the right to appear before an authority and demand that the government justify why he should remain detained.<\/p>","protected":false},"excerpt":{"rendered":"<p>MIAMI, Florida.- When Manaury Olivarez George returned to the United States on June 28, 2025, he did so as a conditional permanent resident.
