Behind that decision lies an extensive administrative record consisting of technical reports, public hearings, diplomatic consultations, and hundreds of pages of official documents that have received little public attention to date.<\/p><p class=\"wp-block-paragraph\">To explain how that decision was reached and what its implications may be for the Dominican Republic, El Faro Latino is launching a documentary investigation based on the official records of the Office of the United States Trade Representative (USTR), U.S. Customs and Border Protection (CBP), and other documents incorporated into the Section 301 proceedings under the Trade Act of 1974.<\/p><p class=\"wp-block-paragraph\">The investigation follows Washington&#8217;s conclusion that the Dominican Republic has not effectively established or enforced a customs prohibition against the importation of goods produced with forced labor, a determination that resulted in the imposition of a 12.5% tariff on a broad range of Dominican products exported to the U.S. market.<\/p><p class=\"wp-block-paragraph\">The official decision, however, extends far beyond the announcement of the new tariff.<\/p><p class=\"wp-block-paragraph\">El Faro Latino has reviewed\u2014and will continue reviewing\u2014the original documents that formed the basis of the proceedings, including the USTR&#8217;s technical report, the final determination imposing the new tariffs, complete transcripts of the public hearings held in Washington, and additional records included in the administrative file. Together, the primary materials exceed 480 pages of official documentation, not including more than 2,100 public comments submitted during the investigation.<\/p><p class=\"wp-block-paragraph\">The investigative series will seek to answer questions that have remained unresolved since the measure was announced.<\/p><p class=\"wp-block-paragraph\">Why was the Dominican Republic included among the 60 economies <a data-efl-existing-link=\"1\" href=\"https:\/\/elfarolatino.com\/en\/puerto-plata-on-alert-over-controversial-biodigester-project-under-review-by-ministry-of-environment\/\">under review<\/a>? What legal arguments did the USTR rely upon in reaching its determination? What took place during consultations with the Dominican government? What do the public hearing transcripts reveal? How did the Kingtom Aluminum case become part of the official record? Which products will actually be subject to the new tariff? And what steps would the Dominican Republic need to take to seek a review of the measure?<\/p><p class=\"wp-block-paragraph\">Each of these questions will be addressed in separate reports based exclusively on official records and primary sources, with the objective of reconstructing, step by step, the process that led to one of the most significant U.S. trade decisions affecting the Dominican Republic in recent years.<\/p><p class=\"wp-block-paragraph\">The investigation will also examine an issue that has been widely misunderstood since the announcement was made. The tariff does not mean that all Dominican companies use forced labor, nor does it suspend the Dominican Republic\u2013Central America Free Trade Agreement (CAFTA-DR). The official record clearly distinguishes between the evaluation of the country&#8217;s trade and customs policies and the evidence related to specific companies. It also establishes multiple exemptions for certain goods and product categories.<\/p><p class=\"wp-block-paragraph\">As part of this project, El Faro Latino will make the principal documents used in the investigation available to readers through its Official Documents section. Each installment will include the corresponding documentary references, allowing business leaders, exporters, attorneys, researchers, academics, and the general public to examine the primary sources supporting the findings published by the newspaper.<\/p><p class=\"wp-block-paragraph\">More than coverage of a new tariff, this initiative is a long-term documentary investigation.
